They'd send us a C&D letter like they did to AC.net once for hosting images of ACC and other SE titles, pretty much. They did that to AC.net back when due to them hosting the trailers, but obviously, the term 'viral marketing' was unknown to SE back then.

And they're sending these letters due to Chrono Trigger and whatnot being their intellectual property and trademark - the fan project used Chrono Trigger graphics and/or designs and the name, which was enough for SE to go after 'em.

On that, I'm actually surprised SE didn't go after AC.net for using one of their trademarks - Advent Children - as the website title / address. That would've made more sense.

Of course, in that aspect, we're safe since TLS isn't registrable as a trademark, afaik :monster:.

I remember some lulz back on FFOF when this dude came onto the forum saying 'We've copyrighted your website name 'Final Fantasy Omega' and we demand you change it!1!1!'. Theirs was a shit and dead fansite, and we had many great lulz. But I made an epic post there stating at least ten facts why they were in the wrong, mainly those being that any and all names containing 'final fantasy' would contain a registered trademark of SE. Plus, 'copyright' != 'trademark'.

Yeah I guess that's more reason to get legal about it.

No, I wasn't on staff back then, and SY removed the videos. This is AC.net we're talking about, :monster:.

I know someone who's making a Sonic fan film and he's said time and time again that as long as no one makes a profit Sega can't do anything about it. Not sure how true that is.. but I'd imagine it's the same here. But I really wish Sega WOULD send him a C&D so he'd finally kill himself

On the other hand.. it is their property so ... I guess they have the right to stop fan projects. But why stop where they did? why not remove all fanfics and fanart as well?

I can't be sure. In the fangames, they use parts of the game's original content and graphics, ergo, they take from a game and put it into another, claiming it as their own. With fanart, I think it's more that it's not a copy, but something similar - likewise, there wouldn't be a problem (I think) if they remade the graphics for the fan game, since it wouldn't use Square's intellectual property. Same applies to the game's code and whatnot, btw.

I think that pissed everyone off about the CT: CE death was that it was stopped when it was. Nearly completely, just two weeks away from distribution, beta tests out, 98% done and then... Nope, stop right there. Not at the beginning, not half way through but 5 YEARS LATER.

Well, there is stuff like Red vs. Blue and other machinima, and now I'm wondering how they manage to avoid srs legal business with their use of Halo/Warcraft/etc, especially given that RvB also sells DVDs.

Square also removed all traces of Advent Children from youtube unless it was a trailer or an AMV. Don't really blame them for that though, ... I'll probably up load my top 10 WTF moments to mega video.
